1. Definitions

“We”, “us”, “our” refers to Swasyn, operator of the Swasyn platform.
“You”, “your”, “User” means any natural or legal person who visits or uses the Swasyn website, mobile application, or any related services and/or purchases services from Swasyn.
“Services” means Swasyn's digital health-tech products and services, including but not limited to appointment booking, patient record management, onboarding tools for medical practitioners, and related software and support.

2. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and Conditions and any other policies published on the platform (including the Privacy Policy). If you do not agree, do not use the Services.

3. Changes to Terms

We may update these Terms from time to time. The date at the top of this page shows when these Terms were last revised. Continued access or use of the Services after changes are posted constitutes acceptance of the revised Terms.

4. Use of the Services

You must use the Services in compliance with applicable laws and regulations.
When registering for an account you must provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must not use the Services to collect, transmit or store patient information except as permitted by law and by our Privacy Policy. When handling patient data you must obtain any necessary consents and follow applicable data protection and health-data regulations.

5. Medical Disclaimer

Swasyn is a technology platform that facilitates administrative, scheduling, and record-keeping tools for healthcare providers. The Services are not a substitute for professional medical judgment, diagnosis, or treatment.
No doctor-patient relationship is established solely by use of the platform unless explicitly stated by the treating practitioner through a documented communication.
Healthcare professionals using Swasyn remain solely responsible for clinical decisions and for complying with standards of care and applicable laws.

6. Content, Accuracy and Availability

We strive to keep information on the platform accurate and up to date, but we do not guarantee completeness, accuracy, timeliness, or fitness for any particular purpose. We may change, suspend or discontinue any aspect of the Services at any time without notice.

7. Intellectual Property

All content on the Services (including design, text, graphics, logos, images, and software) is owned by or licensed to Swasyn and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Services except as expressly permitted in writing by us.

8. Third‑Party Services and Links

The Services may include links to third‑party websites or services. Those links are provided for convenience only. We are not responsible for the content, policies, or practices of third parties. If you make payments through third‑party payment processors (for example, Razorpay or similar), those transactions are subject to the payment processor’s terms and policies. We are not responsible for their performance, security, or compliance.

9. Payments, Refunds and Authorization Declines

Payment terms for paid features or subscriptions will be described at the point of sale. You agree to pay all fees and charges in accordance with the terms presented to you when purchasing services.
All authorisations for payment transactions are subject to the policies and limits of the payment provider and the card issuer. We are not liable for any decline or reversal of authorisation by the acquiring bank or issuer.
Refund policies, if applicable, will be set out separately and may vary by service offering.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SWASYN, ITS AFFILIATES, DIRECTORS, EMPLOYEES OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR INTERRUPTION OF BUSINESS.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU ACTUALLY PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. IF YOU HAVE NOT PAID US ANY AMOUNTS, OUR LIABILITY SHALL BE LIMITED TO INR 5,000.

11. Indemnification

You agree to indemnify, defend and hold harmless Swasyn and its officers, directors, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may suspend or terminate your access to the Services at our discretion, including for violation of these Terms or for suspected fraudulent or illegal activity. Upon termination, your right to use the Services ceases, but obligations that by their nature should survive termination (e.g., indemnification, limitations of liability, intellectual property provisions) will survive.

13. Data Protection and Privacy

Personal data, including any health‑related data collected or processed via Swasyn, will be handled in accordance with our Privacy Policy and applicable laws. By using the Services you consent to such processing as described in the Privacy Policy.
If you handle patient data via Swasyn, you represent and warrant that you will obtain all necessary consents and authorisations required under applicable laws (including any health data regulations) and that you will only process such data in accordance with those consents and Swasyn’s policies.

14. Representations and Warranties

You represent and warrant that you have the legal capacity to enter into these Terms and to use the Services in compliance with all applicable laws.
We provide the Services on an “as‑is” and “as‑available” basis and expressly disclaim all warranties, whether express or implied, to the fullest extent permitted by law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts located in Nagpur, Maharashtra, India.

17. Miscellaneous

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.
These Terms constitute the entire agreement between you and Swasyn regarding the subject matter and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written.
